Customer Terms and Conditions

If you wish to book (“Booking”) a tour (“Tour”) with a tour operator (“Tour Operator”) using Indus Tourism Pakistan (“ITP”) then you (“the Customer”) agree that the following terms and conditions shall apply:

  1. Contract
    By using IndusTourism.PK website or company, you agree to be legally bound by the following Terms and Conditions, which shall take effect immediately. If you do not agree to be legally bound by all the following Terms & Conditions, please do not access and/or use IndusTourism.PK website or company. In all cases the person making the booking shall be deemed to have accepted these Terms and Conditions on behalf of all the other person(s) named in the booking and who partake in the booked tour(s).
  2. Our Service
    ITP through the information on our website aims to publish the most accurate, up-to-date information possible regarding costs, dates and times of the tours listed; this information is bound to change frequently. While ITP undertakes all efforts to update operator information as they occur this is not always possible as quickly as we would like. We therefore cannot guarantee the accuracy of this material and suggest that you use it as a guide only in making your selection.
  3. Accuracy of Information and Limitation of Liability
    1. ITP does not accept liability to the Customer (or any other person) for any act or omission on any accident, loss or damage which the Customer or any other person might suffer as a result of the Tour and the Customer agrees to release and indemnity ITP from and against any such claim in that respect.
    2. ITP does not warrant or represent to the Customer that the Tour is suitable or fit for the Customer’s purpose or corresponds with any advertising of the ITP and the Customer agrees to make their own enquiries with the ITP if required.
    3. In so far as ITP is unable by law or by statute to exclude its liability to the Customer then the Customer agrees that the liability of ITP to the Customer is limited to ITP providing the Tour (or a similar tour) again to the Customer.
    4. You the Customer will indemnify ITP if we suffer any loss or damage or incur any costs in connection with your breach of these terms and conditions or any other legal obligation by you.
    5. All Tours are provided by ITP based on dates of availability of Tours provided on the ITP website or company. ITP is unable to guarantee the availability of any tour included on these websites.
    6. ITP have taken all reasonable care to ensure that the content of this site is correct, but all information is subject to change at any time without notice, & you should make your own independent enquiries with the ITP and other third parties (person or companies) and use your own judgment to assess the accuracy of any information accessed through IndusTourism.PK website or company.
  4. Fees and Charges
    The Customer agrees to pay to ITP the advertised price (“Price”) for the Tour. There is currently no booking fee to place a Booking (“Booking Fee”).
  5. Tour Operator’s Conditions
    The Customer agrees to abide by all terms, conditions and directions of the ITP in respect of the Tour including but not limited to:

    1. All matters regarding the conduct of the Tour such as safety, use of equipment, clothing, etc.
    2. Payment for the Tour — the Customer acknowledges and agrees that the Price charged by the ITP for the Tour may be subject to changes and ITP gives no warranty regarding the accuracy of the ITP’s current advertised prices. ITP will endeavor to abide by the Tour Operator’s advertised Price.
    3. Cancellation Fees — If the Customer cancels or changes a Booking then the Customer agrees to abide by any cancellation or alteration policy of the ITP which may include the payment of a charge for the cancellation or change. BUT the Customer agrees that notwithstanding any cancellation or refund policy, ITP shall at all times be entitled to retain the Booking Fee plus a deposit equivalent to 20% of the Price. In addition to this the Customer agrees to abide by the cancellation policies set out in Clause 7 Cancellations, Amendments and Refunds following.
  6. Age and identity of Customer
    1. ITP will not accept any Booking from the Customer unless the Customer is at least 18 years of age or otherwise adjoined with an adult. The Customer warrants and assures ITP that they are at least 18 years of age or otherwise adjoining with adult.
    2. The Customer will be required by the ITP to provide photo ID at check-in to ensure that their identity matches the booking identity. The customer will also be required by the ITP to sign the booking confirmation/voucher and may be asked to present the credit card used to purchase the tour. A copy of this photo ID and/or signature may be retained by the ITP to minimize the risk of credit card fraud or for legal verification purposes with your credit card provider in the event of a dispute.
    3. Where there is a discrepancy between the photo ID and the booking identity, or the signature on the credit card and the signature on the booking confirmation form, the voucher can be confiscated and immediately cancelled without refund.
    4. If the Customer wishes to pay by credit card for a tour (other than a Gift Voucher) and the person who will undertake the tour is different to the Customer, the Customer must contact ITP after the booking has been confirmed to establish their identity.

 

  1. Permissible and Prohibitions
    1. Weapons, drugs and alcohol are strictly prohibited on all ITP trips and tours.
    2. In event of nature calamity/disaster, land sliding or natural hazards the tour leader (Guide) will decide the plan of action keeping in mind best interests of the group.
    3. We are not responsible to cover these as our guests should take care of their belongings, valuables, money and baggage themselves, loss or damage due to delay, confiscation, legal investigation and check posts or detention by customs or other authority. Partial or full loss/damage of personal items and belongings of individual or group. Depreciation in value or shortages due to error or omission. Business goods, samples, tools of trade, motor accessories or other items used in connection with your employment or occupation. Wear and tear, depreciation, deterioration or loss or damage by atmospheric or climatic conditions by moth, vermin, by any processing of cleaning, repairing or restoring, mechanical or electrical breakdown or derangement.
    4. Also, we do not cover the claims for loss or damage in pregnancy or any claim arising from your failure to comply with important conditions relating to health mentioned below, and we do not allow those customers who are in critical illness or conditions or source of any transferable disease(s).
    5. All tour participants should show good manners and behave nicely throughout the tours/trips. No male or female sexual harassment, quarrels, abusive language, political affiliation will be accepted and may direct / force us to off load the accused (if necessary) or taken to the police custody.

 

  1. Cancellations, Amendments and Refunds
    1. Cancellation by you, the Customer — If you are not able to partake in a Tour on the date and time you have booked you should contact the ITP as far prior to this date and time as possible. ITP’s refund for a tour is based on its Refund and Cancellation policy in clause 7. The Customer agrees that notwithstanding any cancellation or refund policy, ITP shall at all times be entitled to retain at least the Booking Fee plus a deposit equivalent to 20% of the Price.
    2. Cancellation by the ITP (apart from weather) — In some cases ITP may make alterations to a tour date, price, inclusions, itinerary, minimum numbers, ages etc. ITP reserves the right to cancel, change, transfer or substitute any tour that you have booked, at any time and for any reason. If you choose not to accept the alternatives offered you will be entitled to a full refund including the booking fee. Notwithstanding the above, if we receive advance notice of a significant change to a tour, we will make a reasonable effort to communicate this to you and to facilitate an amendment of the booking.
    3. Cancellation because of Weather — If the Tour you have booked is unable to be taken because of weather or force majeure conditions, it may be rescheduled. You the Customer should make contact with the ITP prior to the date and time of travel using the contact details provided on your booking confirmation to organize this. ITP is unable to reschedule or assist in the reschedule of a Tour. The ITP will do all possible to reschedule the Tour to a date and time suitable to you the Customer. If the rescheduled date is not suitable you may be entitled to a refund BUT the Customer agrees that notwithstanding any cancellation or refund policy, ITP shall at all times be entitled to retain the Booking Fee plus a deposit equivalent to 20% of the Price.
    4. If ITP is notified within before the date that a Tour was due to be taken that the Customer did not take the Tour due to any reason then clause 8 will be applicable.
    5. In some instances, bank fees and exchange rates may mean the amount refunded is different to the amount originally paid for a tour, particularly in instances where a currency exchange is involved. ITP warrants it has no control over any bank fees or exchange rates and is unable to accept responsibility for any such discrepancies in refunded amounts.
    6. Gift vouchers are non-refundable.
  2. Refund and Cancellation Policy
    1. In order to make the cancellation and to get the refund you should have informed ITP at least two weeks prior the Tour departure date, with deduction ratio before 14 days = 80% refund of the paid amount, 7 days = 50% refund on the paid amount, 3 days = no refund
    2. No refund in case of no show or reaching foretold place and refunded amount could take up to one month in processing.
  3. Insurance
    Some of the tours promoted by ITP as a booking agent may be potentially dangerous. Prior to making and paying for a booking you the Customer should be aware of this. You the Customer agree to be responsible for making independent enquiries with the ITP and other third parties regarding the need to acquire your own insurance coverage.
  4. Jurisdiction
    The Customer agrees that the terms of this agreement shall be governed by the laws of Lahore City and any dispute shall be heard by the court of appropriate jurisdiction in Lahore City.
